1.
This dog is sold on a
co-ownership as a breeding/show/performance prospect and buyer agrees to
campaign dog in an attempt to attain at least one title. Acceptable titles are AKC or ASCA
Championship, Obedience CDX (ASCA or AKC), Herding OTD or AKC equivalent, or
any of the Open Agility titles. Ownership
of dog will be signed over to the buyer when one of the acceptable titles has
been attained.
2.
Flinthill agrees to
mentor when possible and provide advice when asked.
3.
Flinthill makes no
guarantee that this dog will attain Championship, Obedience, or Stock titles,
as care, training and handling methods needed to achieve the above titles are
beyond our control.
4.
This dog, to the best
knowledge of the seller, is in sound health and free from communicable diseases
at the date of sale.
5.
Should this dog die for
any reason after 48 hours from purchase, the buyer is responsible for full
payment of said dog. Flinthill will
replace said dog if it should die from a proven pre-existing condition. If said dog should require veterinary
attendance within this 48-hour period, Breeder agrees to pay for all reasonable
veterinary expenses upon receipt of a statement from attending veterinarian
that the disease or illness was contracted prior to said 48-hour period. Breeder demands to be notified immediately,
should any illness or disease be detected so a decision may be made on how to
proceed with the veterinary care. If
the Breeder is not notified in advance of treatment, Breeder will not be
obligated to pay veterinary expenses.
Breeder will not cover payments for veterinary attendance for treatment
due to negligence, mistreatment or accident to said dog, or for regular
veterinary examination or shots. The
Buyer will pay for all shipping costs on the replacement dog.
6.
This dog is guaranteed
against Hip Dysplasia. OFA Evaluation
(by an X-ray taken by a qualified veterinarian) must be done no sooner than 24
months and no later than 26 months. OFA
grading of Excellent, Good or Fair are considered acceptable. (Must be rated by OFA). Less than Fair will be replaced.
7.
The Buyer is completely
satisfied and waives and all claims regarding the puppy’s conformation and
outward appearance when the Buyer picked the puppy up from the seller. (Thus meaning that the puppy is of the
Australian Shepherd breed standard set forth by AKC and ASCA at this age.
8.
This dog is guaranteed
against any congenital eye defects as determined by a certified
ophthalmologist.
9.
If the above describe
dog is a female than the following conditions shall apply. 1.
All females must be eye cleared yearly for eyes by a certified
ophthalmologist and be normal/normal before breeding. 2. Females must have permanent OFA certification prior to
breeding. 3. Said bitch shall not be bred before the age of two or after the
age of eight with a maximum of one litter per year or a maximum of six litters in a lifetime. 4.
Should said bitch be bred back to back the bitch shall be rested for two
heats and bred on the third following or a minimum of one and one half years
in-between litters. 5. The male that the bitch is bred to must also
meet the AKC/ASCA breed standard and be OFA and eyes cleared. Above all, all breedings must be done with
the best interest of the breed in mind.
Violation of this portion of the
contract will result in a three thousand dollar per litter penalty or all
ownership registration papers signed over and the animal returned to the seller
with no reimbursement.
10.
If the above dog is a
male than the following conditions shall apply. 1. All males must be eye
cleared yearly by a certified ophthalmologist and be found normal/normal before
breeding. 2. Males must have permanent OFA certification prior to
breeding. 3. Seller retains two
breedings for any bitches owned or leased by Flinthill. 4. Said male is to only be breed to bitches
that meet the AKC/ASCA breed standard and are OFA and eyes cleared. Above all, all breedings must be done with
the best interest of the breed in mind.
Violation of this portion of the
contract will result in a three thousand dollar per litter/occurrence penalty
or all ownership registration papers signed over and the animal returned to the
seller with no reimbursement.
11.
Breeder
retains the right of first offer of purchase should the Buyer decide to sell
said dog for any reason at a later date.
Buyer will notify Flinthill in writing.
Purchase price shall be no more than the price paid to the Breeder on
the above date. Violation for not
giving first right of refusal to Seller shall be a fine of $2500.00 and this
contract becomes null and void.
12.
FLINTHILL RESERVES THE
RIGHT to reclaim the puppy/dog
named in this contract at any time for any of the following reasons:
a.) Poor care of the
puppy/dog’s health and/or
b.)
Improper
fencing/chaining the dog to any object and/or physical rutality to the dog
and/or
c.)
It is realized the
offspring of this dog are being sold to retail store, puppy mill, or auction.
If it should become necessary to reclaim puppy/dog for any
reasons there will be no compensation to the Buyer and all registration papers
and rights of ownership will be released by the Buyer to the Seller.
13.
Flinthill will supply
the Buyer with complete health records of the dog. We will supply a complete pedigree OFA
Evaluation numbers of sire and dam.
14.
If either party is
forced to take legal action to enforce any part of this contract, action shall
be initiated in the county of Breeder’s residence, and any legal fees and court
costs shall be the responsibility of the party found to be in default.
15.
Flinthill reserves the
right to fine the buyer up to $3500.00 or repossess said dog if a breach of
contract occurs.

NOTE: All guarantees become null and void when the
animal is 30 months of age.
This agreement is made and signed by both parties to insure
the well being and protection of this animal.
By signing this contract agreement, you have read and
understand and agree to up hold everything stated in this sales contract.
